We reserve the right to limit, refuse or cancel orders, and terminate accounts for our own reasons.

These general conditions of purchase do not affect your legal rights.

1/ DEFINITIONS

Buyer: person who orders the Product

Manufacturer: original manufacturer of the Products

Contract: firm and final order of a product placed on the Site by the Buyer and presupposing approval of these General Conditions of Sale by the Buyer,

Parties: Buyer and Seller

Product: item for sale on the Seller’s Site and likely to be the subject of an order by the Buyer

Site: refers to the online product store of Amadeus Art Company and accessible via the web address jonone.com/shop

Contract territory: Worldwide

Carrier: transport company responsible for transporting products purchased on the Site.

User: person who accesses and consults the Site without making a purchase on the Site, regardless of their status (individual or professional), their location, the terms of their connection to the Site, the reason and purpose of their access to the Site.

Seller: SAS Amadeus Art Company

2/ SUBJECT

The subject of these general conditions of sale is the Site operated by the company Amadeus Art Company which offers products for sale online. These general conditions of sale aim to specify the rights and obligations of the User and the Buyer regarding the Products sold on the Site, as part of an e-commerce system of sale.
Any User and any Buyer acknowledges being accurately informed of the fact that their agreement regarding the content of these general conditions of sale does not require the handwritten signature of a sales contract.

All Contracts concluded on the Site are expressly subject to these general conditions of sale.

These general conditions of sale prevail over all other general or specific conditions not expressly approved by the Seller. The Seller reserves the right to modify these general conditions of sale at any time. These modifications will only be applicable to sales completed after the posting of the modified general conditions of sale on the Site.

The buyer is invited to read the general conditions of sale in force on the day and before validation of their order. In the event that a User or a Buyer does not wish to accept all or part of these general conditions, they are asked to renounce any use of the Site.

The seller advises all Users and Buyers to save and/or print these general conditions of sale for safe and long-term storage, allowing them to be able to invoke them at any time during the execution of the contract if necessary.

3/ THE PRODUCT OFFER

Product offers and prices are only valid as long as they are visible on the site and while stocks last. All prices indicated on the Site are in euros, all taxes included for French and European territories (excluding specific bank charges).

Transport and packaging costs are not included in the prices.

The purchase of the “Skateboard Krink x JonOne” product is limited to one (1) product per purchaser. Any order of the product “Skateboard Krink x JonOne” with a quantity greater than one (1) product will be canceled.

The prices indicated take into account the VAT applicable on the day of conclusion of the Contract as per French rates. Any change in the rate may be reflected in the price of the Products. The price indicated at the time of conclusion of the Contract, that is to say at the time when the buyer clicks to validate their order, is guaranteed for 20 (twenty) days. In all other cases, the Seller reserves the right to modify prices at any time and without notice.

In the event of immediate unavailability of the Product, the Buyer will be informed by e-mail as soon as possible and their order will be canceled unless they opt for delivery of the Product within a new period.

In the unlikely event that the Buyer’s account has been debited when the item is no longer available and the Buyer does not opt for one of the solutions envisaged above, they will be automatically refunded as quickly as possible and at the very latest within 30 days of payment.

4/ COMPLIANCE AND PRODUCT GUARANTEES

The Seller is responsible for any lack of conformity existing at the time of delivery of the Product, the description of which appears on the Site. The Seller invites the Buyer to mention upon delivery and as quickly as possible any lack of conformity in contacting the seller by e-mail shop@jonone.com, providing an:

order number

surname, first name and address

reference of the item(s) to be returned

reason(s) for return for non-compliance

The Seller will provide the Buyer with a reference number and the procedure to follow to ensure optimum management of the return(s).

We have made every effort to describe our products as accurately as possible and to provide correct information. We have also made every effort to represent the colors of our products as accurately as possible. However, it is possible that the colors vary depending on screen quality, so we cannot ensure that the display reflects the accurate color of the product.

In the event of a lack of conformity, the Buyer chooses between reimbursement of the Product and replacement of the Product.
The Buyer acknowledges that the guarantee of conformity does not apply in the event of excessive use compared to intended use.

5/ THE ORDER

How to place an order:

The order process implemented on the Site Jonone.com complies with the provisions of article 1369-5 of the French Civil Code specifying the terms of conclusion of contracts in electronic form. This ordering process proceeds as follows:

1/ the Buyer selects their Product(s) by clicking on “Add to Cart”, then views their virtual cart by clicking on “View Cart”, then finally validates their virtual cart after checking the contents by clicking on the “Proceed to Checkout” button.

2/ The Buyer fills out their Billing and Delivery Details (information relating to their identity and place of delivery including a telephone number for delivery arrangements).

3/ The Buyer checks the details of their order and the amount to be paid and corrects any errors.

4/ The Buyer chooses the method of payment and reads and accepts the general conditions of sale by ticking the box provided for this purpose.

5/ The Buyer validates their order by clicking on the “Proceed to Paypal” button which constitutes irrevocable acceptance of their order in compliance with these general conditions of sale.

6/ The Buyer receives an order confirmation, followed by a second e-mail confirming the processing of the order by our logistics services and acceptance of payment.

Validation of payment by the Seller binds both parties to the Contract. The order can only be delivered to the precise and full address provided. The Buyer must verify the accuracy of the information given for the address of delivery. The Seller disclaims all liability in the event that the Buyer indicates an incorrect address and the Fees of reshipment costs will be the responsibility of the Buyer, including in the event of an entry error. The Seller reserves the right to refuse an order in whole or in part. The Buyer may obtain communication of the reasons for this refusal by simple request.

6/ PAYMENT

The full price is due upon shipment of the product.

There is transfer of ownership only after payment of the entire price. However, there is transfer of risk upon receipt of the Product.

The Buyer opts for the payment method offered on the Site, namely: PAYPAL

The delivery time therefore runs from the date the payment is recorded. Payments by Paypal are debited upon shipment of the products. If payment has not reached the Seller’s bank account 15 (fifteen) days after confirmation of the corresponding order, regardless of the payment method used, this order is automatically canceled.

— The Seller does not store the bank card data of its customers on its website.

The Seller, in the order process described above, is only bound by an obligation of means. The Seller cannot be held responsible for any damage resulting from the use of the Internet network such as: Loss of data / Intrusion / Virus / Disruption of service / Other problems beyond the control of the
Seller.

7/ DELIVERY

The online sale of Products on the JONONE.COM website delivers its products to the geographical areas (contractual territory) covered by our delivery providers only.

For deliveries outside the European Union, it is the buyer’s responsibility to pay taxes and/or customs duties specific to the country concerned.

The items are delivered to the address indicated by the Buyer on the online order form (delivery address).

The Seller bears the risk during transport and until delivery but under the following conditions:

The Buyer must have checked the compatibility of access to the delivery address and particularly the size of the stairwell and doors in the event of delivery of a large Product. The Buyer will be solely responsible in the event of impossibility of access to their final access door for the reasons mentioned above.

The Buyer or a person authorized to represent them must be present on the date and during the time slot agreed with the carrier. If the Buyer is absent and no authorized person has been designated, delivery will not be possible and the costs linked to a new delivery will be their responsibility.

In the event of unjustified absence of the Customer and/or impossibility of delivery, a new delivery service may be scheduled at the next available slot after payment of an amount equal to the initial shipping costs. The delivery times generally observed for an order where the product is in stock is 4 to 7 working days. The delivery time generally observed is given for information purposes only. The delivery time is expressed in working days after shipping your
order. In the case of payment by transfer, it starts from the recording of the payment.

However, in the event of Force Majeure such as disruption or strikes, in particular postal services, transport services, in the event of flooding or others, the liability of the Seller or the Carrier cannot, under any circumstances, be engaged in the event of late delivery. Delivery entails the transfer of risk to the Buyer. Also, the Buyer is invited to formalize written, significant and complete reservations on the dated and signed delivery note, concerning any damage, packaging defect or incomplete order noticed by the Buyer. It is strongly recommended to refuse any delivery of a damaged package or whose contents are damaged. It is also recommended, without prejudice to applicable legal guarantees, to send any reservations by email to the Customer Service team of
Jonone.com (
shop@jonone.com) as soon as possible.

Verification of deliveries: The contents of the packages have been subject to a certified check before dispatch.

8/ RIGHT OF WITHDRAWAL

The Buyer has a period of 15 clear days to exercise their right of withdrawal from the date of receipt of the Product without having to provide justification and without penalty.

If the right of withdrawal is exercised, the Seller will reimburse the Buyer for all sums paid as soon as possible and at the latest within 30 days of receipt by the Seller of the returned product. Reimbursement may be made by any means of payment or with the agreement of the Buyer in the form of vouchers for a Product with a value of less than 1000 euros. The basis for reimbursement concerns the totality of the sums paid. But the Costs of returning the Product are the entire responsibility of the Buyer.

The Seller may also offer a Product of equivalent quality and price. The Products must be returned by a carrier in their original condition and complete with their original packaging, with a copy of the invoice and sufficient postage. Products that are incomplete, damaged or soiled by the Buyer or which have been subject to abnormal use will not be accepted as returns.

No returns will be accepted other than those in conformity with the following procedure:

RETURN PROCEDURE:

2 – Indicate in the subject of the email: RETURN REQUEST + ORDER NUMBER

3 – Specify the reason for return in the body of the email

We will contact you within 72 hours maximum to notify you of the agreement or refusal of the return. If the return is granted it will be the responsibility of the Seller.

JONONE.COM Customer Service will communicate to the Buyer all useful information on the procedure to follow for optimal management of returns.

9/ CONTRACTUAL GUARANTEES

The products sold benefit from the one-year legal guarantee against hidden defects provided for by articles 1641 et seq. of the French Civil Code unless otherwise indicated on the Item page at the time of the transaction.

The repair or exchange under warranty of an item distributed by the Seller does not in any way modify the initial expiry date of the contractual guarantee, that is to say the expiry date which was defined from the invoice date of the item. In all cases, the Seller’s liability only covers the replacement or repair of the defective part or material without any additional compensation or damages being claimed for any reason.

Damage of external origin to the item itself is excluded from the scope of the guarantee. This concerns in particular shocks, fires, lightning, frost, floods, natural disasters, etc. Damages resulting from abnormal use of the item as described in the instructions are also excluded from the scope of the warranty notice supplied with the item. In all cases the transport costs for returning an item remain exclusively the responsibility of the Buyer. This paragraph does not prevent the application of the legal guarantee against hidden defects, as it results from articles 1641 et seq. of the civil code.

10/ RESPONSIBILITIES

The Seller has a sales activity to the exclusion of any installation or assembly operation. The Seller performs its services within the framework of an obligation of means. All items distributed by the Seller comply with French legislation and the standards applicable on French territory. The Seller cannot be held responsible in the event of non-compliance with the contract if the cause of non-performance results from a case of force majeure or unavailability of the product.

11/ RESPECT FOR COPYRIGHT

All elements of the Site are and remain the intellectual and exclusive property of Amadeus Art Company. The reproduction of all documents published on the site is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. All brands mentioned on this site belong to their respective companies. All products, logos, and images cited in the pages of this site are the property of their respective brands. The photographs reproducing the products are not contractual.

12/ RIGHT OF ACCESS AND MODIFICATION OF PERSONAL DATA

The information collected is subject to computer processing intended for the processing of the online order and subsequent contractual obligations, such as guarantees. It may be used for commercial prospecting and promotional communication linked exclusively to the activities of JONONE.COM or to any administrative or judicial authority which requests it.

In accordance with the Data Protection Act of January 6, 1978, you have the right to access, modify, rectify and delete, without any charge, your personal data. You can exercise these rights by writing to Amadeus Art Company, 58 rue de l’alouette 59100 Roubaix — France or by email: shop@jonone.com, attaching a photocopy of your double-sided identity document.

“Personal Information 1140240” means any information that allows a person to be identified. This will most often be a name, address, telephone number or email address.

14/ INDEPENDENCE OF CLAUSES

If any part of these general conditions of sale should prove illegal, invalid or unenforceable for any reason whatsoever, the term or terms in question will be declared non-existent and the remaining terms will retain their full force and scope and will continue to be valid. The terms declared non-existent are replaced by one or more terms which are closest in terms of the content of the canceled clause.

15/ DISPUTES AND JURISDICTION

French law governs these General Conditions of Sale. For a professional Customer: any dispute (including preliminary ruling) will be under the exclusive jurisdiction of the Commercial Court of Lille Métropole. For a consumer Customer: any dispute (including preliminary ruling) will be the responsibility of the courts designated as competent in application of article L.141-5 of the French Consumer Code.
